Article 1 — Parties and Definitions

1.1. Operator

This mobile application (“TOU”), a global food recipe and social sharing platform, is operated by Bin Teknoloji Yazılım LTD ŞTİ, located in Istanbul.

1.2. User

Any natural person who downloads, accesses, registers for, or uses TOU on any device.

1.3. Agreement

This “End User License and Terms of Use Agreement”.
By downloading or using the Application, the User is deemed to have read, understood, and unconditionally accepted all provisions herein.

Article 2 — Nature of Service & Free Use Guarantee

2.1. Service Description

TOU allows users to share, discover, rate, save, and socially interact around food recipes and culinary experiences.

2.2. Free Application Policy

TOU is completely free of charge.
The Operator does not request, charge, or collect any of the following from Users:

  • Subscription fees

  • In-app purchase fees

  • One-time payments

  • Donations

  • Mandatory upgrades

  • Hidden charges

All primary features are provided at no cost.

2.3. Minimum Age Requirement

If the User is under 18, the application must be used with the permission of a legal guardian.

2.4. Account Responsibility

The User is responsible for the confidentiality and security of their account information.

Article 3 — Intellectual Property Rights

3.1. Operator Content

All elements of TOU including brand, logo, design, interface, software code, database structure, algorithms, and visual materials created by the Operator (“TOU Content”) are protected by Turkish and international copyright laws.

3.2. User Generated Content

Recipe texts, photographs, comments, videos, and all content shared by Users (“User Content”) remain under the responsibility of the User who uploads them.

By sharing content, the User grants TOU a worldwide, royalty-free, perpetual, and sub-licensable right to store, display, reproduce, and distribute such content within the platform operations.

Article 4 — User Obligations and Prohibited Activities

The User agrees not to:

  • Share copyrighted content without permission

  • Share misleading, abusive, defamatory, hateful, or harmful content

  • Share another person’s personal data without explicit consent

  • Upload harmful scripts, viruses, bots, automation tools, or attempt reverse engineering

  • Create fake accounts or manipulate the platform

  • Use the platform for advertising, commercial spam, or unauthorized promotions

Violation of these rules may result in content removal, account restriction, or termination.

Article 5 — Content Moderation

The Operator reserves the right to monitor, review, filter, edit, limit visibility, or remove any User Content that violates this Agreement or the TOU Community Guidelines.

The Operator may suspend or terminate accounts without prior notice if necessary for community safety or legal compliance.

Article 6 — Personal Data Processing

User personal data is processed in accordance with Turkish Law No. 6698 (KVKK), GDPR, and other applicable legislation.

Details regarding data collection, storage, retention, legal basis, and user rights are outlined in the TOU Privacy Policy.

Article 7 — Account Deletion and Data Deletion

The User may delete their account at any time from within the application.
Upon deletion:

  • Personal data is erased or anonymized within legal time limits

  • Some operational/analytics data may be retained anonymously for security and statistical purposes

  • The User will no longer be able to access their content or interactions

Article 8 — Third-Party Services

TOU may use third-party infrastructures such as:

  • Cloud hosting (AWS, Google Cloud, DigitalOcean)

  • Media storage (S3, Cloudflare R2)

  • Push notification services

  • Analytics and security systems

These services may process technical data necessary for the functioning of the Application.

Article 9 — Warranty Disclaimer

TOU is provided “as is” and “as available”.
The Operator does not guarantee:

  • Uninterrupted or error-free operation

  • Compatibility with every device

  • Availability of all features at all times

  • Accuracy, reliability, or completeness of any User Content

Using the application is at the User’s sole responsibility.

Article 10 — Liability Limitation

The Operator is not responsible for:

  • The accuracy, safety, or health suitability of recipes shared by Users

  • Any allergic reactions, health effects, injuries, or material damages arising from applying recipes

  • User disputes, comments, or interactions

  • Any data loss or service interruption

The User applies recipes and interacts with other Users at their own risk.

Article 11 — Changes to Terms

The Operator may update this Agreement when necessary.
Updated versions will take effect upon publication within the application.
Continued use after an update constitutes acceptance of the revised version.

Article 12 — Notifications and Communication

By installing the application, the User consents to receiving push notifications.
Notifications may be disabled through device settings.

Article 13 — Governing Law and Dispute Resolution

This Agreement is subject to Turkish law.
Istanbul Courts and Enforcement Offices have exclusive jurisdiction for resolving disputes arising from this Agreement.

Article 14 — Effectiveness

This Agreement becomes effective on the date the User downloads or starts using the Application.
